    The “South Island” wine trade mark case

    I have acted for New Zealand Winegrowers on a trade mark dispute with Woolworths.  Woolworths applied for a trade mark which included the words “South Island” and a picture of a mountain in relation to wine.  NZW opposed that application, and in January the Assistant Commissioner of Trade Marks ruled in favour of my client and awarded it costs.  A copy of the judgment can be found here.

    An article about the case can be found here.  Woolworths has not appealed the decision and the deadline for doing so has now passed.
